Jeremy William Lindsay pleads guilty to stalking woman at her hinterland home

A man who escaped a stint behind bars for exposing himself to children has ran out of luck after stalking a woman outside her home while touching himself with no clothes on.

A Nambour man who exposed himself to children on the street has come before the courts again for lurking outside a woman’s home while naked and touching himself.

Jeremy William Lindsay stalked his 30-year-old victim, who lived alone, five times between January 5 to March 15, where he would trespass on her property with no clothes on and masturbate.

What began as a random chat about metal in the woman’s fence, between the woman and Lindsay at her front door one day, led to the 40-year-old loitering in her yard late at night and in the early hours of the morning, on one occasion peering inside her home.

Police prosecutor Jeanette Grigoris said the woman found the Nambour man’s behaviour “frightening and disturbing”, which she said was escalating due to his previous criminal history, and asked for time behind bars.

Maroochydore Magistrates Court was told on Friday how these charges occurred after he exposed his penis to children on the street outside his home at Nambour in 2023.

Lindsay was given a suspended jail sentence after he pleaded guilty to three counts of indecent treatment of children in the Maroochydore District Court on Monday.

Exceptional circumstances were recognised by the court for Lindsay not to spend time behind bars due to his mental health conditions and his acquired brain injury, where he was described as potentially being a “vulnerable inmate” while behind bars.

This was again discussed during his sentencing hearing on Friday after he pleaded guilty to two charges of trespass and one of stalking.

The court was told he was also on a probation order at the time of the stalking from September last year. He pleaded guilty to an indecent act in a public place where he masturbated in front of a woman and her eight-month-old child who were on their front lawn in broad daylight.

Defence solicitor Madalyn Olivero claimed Lindsay did not have the required degree of support through the National Disability Insurance Scheme at the time, and asked for a sentence where he stayed in the community.

Ms Olivero conceded it was inherently serious offending which called for concern, but said a re-evaluation of his NDIS package meant he received improved support to the estimated value of $355,000, which began in May this year.

The solicitor said most of this went to housing but also to supervision which monitored Lindsay between 12 to 19 hours a day. She stated the stalking came at times of the day where he was not supported and not properly funded.

Ms Olivero said this renewed NDIS funding partnered with court orders would give magistrate Raelene Ellis confidence he would not reoffend.

Ms Ellis however was not swayed, pointing to Lindsay’s resistance to probation officers previously who believed he resisted responsibility and presented as a “heightened risk” of committing sexually motivated offences.

Lindsay was jailed for 18 months, with a parole date set at October 24. She noted his disability and how custody would be more difficult for him.
