Jeremy Lindsay pleads guilty to indecent act outside Moffat Beach care facility

A man who has hundreds of thousands of dollars in disability funding for 24/7 supervision has touched himself again in view of a woman and her young child.

A repeat public masturbator on a $355,000 National Disability Insurance Scheme package has come before the court yet again for exposing himself to the public.

Jeremy William Lindsay was a regular fixture over the past week and a half in the Maroochydore courthouse, where he appeared for three separate incidents of indecent behaviour in public.

In his latest appearance in Maroochydore Magistrates Court on Monday, it was revealed the 40-year-old was caught touching himself in broad daylight at Moffat Beach on July 9.

Police prosecutor Jeanette Grigoris said the Nambour man was on a footpath outside an assisted care facility when he masturbated in front of a woman and her young child who were 15m away.

Sergeant Grigoris said the woman saw Lindsay’s jeans pulled down towards his hip which exposed his penis, and touched himself for five seconds while he stared.

The victim had seen Lindsay previously and knew he lived at the care facility.

She walked about 10m to a small table nearby and spoke to a carer who knew the 40-year-old as “Jeremy” and could also see him.

The carer reported the matter to his supervisor who reported it to police.

A notice to appear for the charge of an indecent act in a public place only made it into the 40-year-old’s hands at the weekend following his last court appearance in Maroochydore Magistrates Court on July 25.

During that sentencing hearing, the court was told Lindsay nakedly stalked a woman outside her home five times over two months while masturbating.

He pleaded guilty to stalking and two counts of trespass and was jailed for 18 months, with a parole release date set after two months on October 24.

Lindsay faced court days earlier on July 21, where he admitted to three counts of indecent treatment of children in 2023.

The Nambour man was given an 18-month jail sentence that was immediately suspended, after he masturbated in front of three young children who walked along the street outside his home.

Sergeant Grigoris said this was not the 40-year-old’s first rodeo and pointed to another indecent act in a public place offence in September last year.

In identical circumstances, Lindsay was seen masturbating by a woman who was in her front yard with her young child.

He was given probation after a plea of guilty.

What was a crucial part of defence submissions during his two sentence hearings last week was the fact Lindsay was approved for an improved NDIS package in May this year, which totalled $355,000.

Lindsay’s previous lawyer Madalyn Olivero submitted at one of the hearing’s how Lindsay needed supervision between 12 to 19 hours a day, with this new funding doing just that.

Sergeant Grigoris said despite what was meant to be 24-hour care with stringent supervision, Lindsay found a way to offend once again.

Defence solicitor Michael Robinson submitted, like Lindsay’s previous solicitors, that the 40-year-old suffered from paranoid schizophrenia and had an acquired brain injury after he fell from a roof 11 years ago.

“I asked him … if that was during the course of employment and he said ‘no unfortunately I was running away from the police’,” Mr Robinson said.

The solicitor said if this charge was dealt with at the same time on Friday, he would receive a similar parole release date.

Magistrate Anna Smith agreed, and jailed him for two months after his plea of guilty to an indecent act in public. He was again given the same parole release date of October 24.
