A Maroochydore man has been sentenced after he “spontaneously” grabbed a teenager’s penis, a court has heard.

Jai Kadeem Mott was placed on a nine-month probation order after he pleaded guilty to one count of sexual assault on April 22, 2021.

Police prosecutor Lee Allan said Mott and the victim had a brief conversation before he grabbed the man’s penis.

“(Mott) … used his hand to take hold of the victim’s penis … outside of light cotton shorts the victim was wearing at the time,” he said.

Senior Constable Allan said the victim had told Mott to stop when he removed his hand after several seconds and left the room.

Constable Allan said Mott had previously been given a six-month suspended sentence for an assault occasioning bodily harm offence in 2018.

He said Mott attacked a support worker for asking him to do his chores.

“She was working on a computer, (Mott) has entered the room and punched her numerous times to the face and pulled her hair,” he said.

Constable Allan said the sexual assault offence carried a maximum penalty of 10 years in prison, but said probation or a six-month suspended sentence was in range given Mott’s intellectual disabilities.

Solicitor Ben Rynderman told the court a delay in the matter being finalised was caused by investigations into Mott’s capacity to be sentenced in a criminal court.

Mr Rynderman said Mott had long standing medical diagnoses and cognitive disabilities including ADHD, Tourette’s syndrome and schizophrenia.

He said a six-month probation order would be a suitable punishment.

Magistrate Rod Madsen said Mott’s offending was not premeditated and didn’t include any threats.

“It was a spontaneous decision,” he said.

Mr Madsen said he didn’t believe a suspended prison sentence was appropriate given Mott’s circumstances.

“While it would have been distressing for the victim I’m not sure this is a case where high general or personal deterrence is required,” he said.

“It was regrettable decision you made at that point in your life that has potentially made some impact on some people.”

He noted Mott had entered a plea of guilty and made frank admissions to the offending.

“He didn't know why he did what he did, it just happened,” Mr Madsen read from a report.

“I wasn't thinking straight” and he said he knew it was “inappropriate”.

Mr Madsen said Mott hadn’t “persistently offended” and suggested a 12-month probation order.

“He is managing with his supports to make good decisions and live a blame free life which I can say a lot of people with his difficulties don't,” he said.

Mr Rynderman said a probation order would overlap with the current 24/7 support given to Mott.

Mr Madsen ultimately placed the 25-year-old on a nine-month probation order.

Mott thanked Mr Madsen for his understanding.

“I do understand what I did was wrong and I intend to keep a promise and abide by laws properly,” he said.

Convictions were recorded.
