Deeanne Baumann pleads guilty to spit attack at Tewantin

A Noosa Shire street has witnessed a disgusting assault at the hands of a discount shop manager where she spat in a man’s face, who the court heard assaulted her years earlier.

A Buderim woman dished out a revenge attack on a man who was convicted of assaulting her by spitting in his face outside a Tewantin supermarket, a court has heard.

Maroochydore Magistrates Court heard Deeanne Lee Baumann, 26, saw red on December 12 along Poinciana Ave when she spotted her old attacker about 12.40pm.

Police prosecutor Brendan Newman told the court on Wednesday the discount shop manager saw the victim on the street and began to yell at him from behind.

Sergeant Newman said the man recognised Baumann from an incident where he had to go to court and had not seen her since.

The man walked away from the 26-year-old however she followed him. He threw his hands in the air when he arrived at Woolworths and told Baumann to leave him alone as she walked closer.

The court heard Baumann spat directly in the man’s face.

“You spat in my face,” the man said to Baumann as he wiped the spit away.

“You f---ed my sister,” the Buderim woman yelled during the wild fracas on the street.

A police complaint was made and Baumann was later arrested by police, however the 26-year-old said she couldn’t recall spitting at him.

She said she became aggravated by seeing the man but denied the feral act, where she claimed she had a witness to support her version of events.

Sergeant Newman said grainy CCTV footage appeared to show her making a bodily motion as though she was spitting but she said she pretended to charge at him.

She was charged with common assault, which she pleaded guilty to in court on Wednesday.

Defence lawyer Rose Killip said there was backstory between the pair where it was revealed the man assaulted Baumann in 2021. She said the man was charged and convicted of assault occasioning bodily harm.

Ms Killip said it wasn’t an excuse for the assault but gave context to what occurred.

The solicitor said the discount store manager was a contributing member of society and hadn’t offended similarly since 2019.

Magistrate Rod Madsen said Baumann’s history was “littered” with violent offending, and labelled it “concerning”.

Mr Madsen said it was an unprovoked attack on the man but accepted she was justifiably “unhappy” about what had happened to her.

The magistrate however did not excuse the feral assault which could spread “serious contagious illnesses”.

Baumann was sentenced to six months’ jail, suspended for 18 months.
