A 21-year-old Mooloolaba seafood chef was on bail for serious charges and banned from Sunshine Coast venues when he sneakily entered a popular tavern before making a bold attempt to escape police.
David Kekere Dou was fined $1200 after he pleaded guilty in Maroochydore Magistrates Court on Monday to three charges including obstructing police in a licensed premise.
Police prosecutor David Hoffman said Dou was banned from the Duporth Tavern when he was recognised by security guards on November 21 at 11:30pm.
Senior constable Hoffman said police were talking with Dou when he failed to make a daring escape.
“… (Dou) has quickly jumped up from his seat and made a run for it to the fence and climbed over it to get away from police,” constable Hoffman said.
The 21-year-old was quickly caught by police, who had to use force to get him in a police van.
“(Dou) … refused to get into the van and police had to use force to close the door,” constable Hoffman said.
Dou, who tried to give police a fake name, entered the venue before ID scanners were set up and later blew an alcohol reading of 0.190.
The court heard 21-year-old was on bail for three charges including two counts of affray and assault occasioning bodily harm.
He also pleaded guilty to breaching his bail conditions, including one that banned him from drinking.
Duty lawyer Rachel Holland said the Mooloolaba Fisheries Seafood Bar and Grill employee had no excuse for the behaviour.
“He was out with his mates and he knew he shouldn't have been out,” she said.
Ms Holland said Dou lost his parents in 2020 and lived with his sister.
Both Ms Holland and constable Hoffman agreed fines were in range for the offending.
Magistrate Haydn Stjernqvist said Dou had breached a number of his bail conditions that were recently given to him on November 17.
“You’re trying to avoid detection, you obstructed police, and you breached bail conditions,” he said.
“I think the reading, for someone who was not supposed to consume alcohol, at .190 was a fair breach.”
Mr Stjernqvist said he was considering a suspended sentence, but ultimately landed on a fine, given the 21-year-old’s plea of guilty and overnight stay in custody.
“Be very careful what you do in the near future … you’re going to be on bail for a long time,” Mr Stjernqvist said.
Dou didn’t say anything when Mr Stjernqvist asked if his time in custody was “good fun”?
He was also banned from all Sunshine Coast Safe Night Out Precincts except when he was working at the Fisheries Seafood Bar.
Convictions were not recorded.
