A 41-year-old Maroochydore man has narrowly avoided time behind bars for a brutal attack where he shoved his fingers into the eye of a one-eyed woman and caused bleeding.

A 41-year-old Maroochydore man who jammed his finger into a woman’s remaining eye has narrowly avoided prison for the serious assault.

Daniel Peter Toomey spent months in custody after being charged with assault occasioning bodily harm among other unrelated offences.

Maroochydore District Court heard the 41-year-old scaffolder and a woman were together at an apartment on the Sunshine Coast on October 24, 2020.

Crown prosecutor Greg Cummings said Toomey forcibly shoved his finger into the woman’s eye during an argument.

Judge Glen Cash said the assault stemmed from a suspected stolen wallet.

He said Toomey had pressed his thumb into the woman’s only eye and caused bleeding.

Mr Cummings said since the attack the woman lives “in fear” of seeing him again.

Maroochydore District Court heard Toomey had been in custody for 387 days on unrelated matters.

Defence barrister Nathan Turner said the Sydney-born man had been grappling with substance and alcohol abuse throughout his life.

Toomey pleaded guilty to assault occasioning bodily harm and was sentenced to 12 months’ jail but given immediate parole.

Judge Cash also declared 145 days spent in custody as time served.
