A Sunshine Coast man has avoided more time behind bars after he grabbed a woman by the throat and shook her for declining to have sex with him.

Bryan Alexander Waters was sentenced to one year in prison after he pleaded guilty to common assault – domestic violence on May 5, 2021.

Crown Prosecutor Stipe Drinovac told the court Waters and the woman had been drinking in Forest Glen when he became upset that she refused to have sex with him.

“He grabbed her around her chest, shook her and said ‘what’s the matter with you? You don’t f---ing love me at all do you?,” he said.

Mr Drinovac said Waters then assaulted the woman for saying she didn’t want a relationship.

“The defendant said ‘f--k you that’s it’ and grabbed her throat and forced her head back onto the couch.”

The court heard the woman was able to break free from Waters’ grip and sought safety with a neighbour until police arrived.

Mr Drinovac said Waters was particularly “heinous” when he placed blame on the woman.

“She brings it on herself, I’m not being angry, I’m being just,” Waters told police.

The court heard Waters blew a blood alcohol reading of 0.130 per cent after the attack.

Mr Drinovac suggested a 12 to 15-month prison sentence for the offending.

He noted the 46-year-old had served five months’ pre-sentence custody and said he could be released on parole.

Barrister Mark Dixon said Waters had no domestic violence history and asked for a one-year prison sentence with immediate release on parole.

Mr Dixon said Waters had developed significant problems with alcohol and was medicated for Schizophrenia.

He described Waters as a functioning alcoholic who had worked as a plumber, cleaner and newspaper delivery driver.

Mr Dixon noted the man had entered his plea of guilty despite the victim expressing a desire not to proceed with the charge.

“My client ultimately accepts his responsibility,” he said.

The court heard it was the first time Waters had spent time in custody.

Judge Glen Cash declared Waters’ 160 days of pre-sentencing custody as time already served and released him on parole.

“Some people just shouldn't drink and it seems to me Mr Waters you’re one of those people,” he said.
