A sleepy labourer was fed up with his noisy neighbours when he threw a knife towards a man and slapped another in the face, a court has heard.
Aaron Ron Spillman was fined $500 in Maroochydore Magistrates Court on Tuesday after he pleaded guilty to serious assaulting a person over 60 and going armed to cause fear at the Nambour Caravan Park on August 30.
Police prosecutor Mick Ruddiman told the court Spillman’s neighbours had been watching possums outside their cabin when the 37-year-old threatened the man with a six-inch bladed knife.
“The victim moved back towards his cabin door and armed himself with a lump of wood to protect himself from the knife,” Sergeant Ruddiman said.
“ … (Spillman) threw the knife towards him, but he was able to close the door and the knife hit the door or somewhere near the door.”
Sergeant Ruddiman said Spillman also slapped another man in the face.
“I’m sick of you keeping me awake at night,” Sergeant Ruddiman said Spillman said to the victim.
Sergeant Ruddiman said Spillman had dated history and the matter could be seen as an isolated incident.
He suggested a fine as an appropriate punishment.
Spillman’s solicitor Matt Cooper said the labourer got up for work at 1am each day and was regularly woken up by the males talking loudly outside his bedroom window.
Mr Cooper said Spillman was disappointed in his actions and had offered to pay $500 compensation to the victim.
He said no one was hurt and Spillman had entered a quick plea.
Mr Cooper suggested a $500 fine and $500 compensation as an appropriate punishment and asked for no conviction to be recorded.
Magistrate Kenneth Taylor ordered Spillman to pay $500 in compensation to the serious assault victim
No convictions were recorded.
