Nicholas Alan Semler Mitaros to face trial over death of Dawlon Smith-Saunders

The next steps regarding the case of a Sunshine Coast man accused of an horrific car crash that killed a boy riding a scooter have been detailed in court.

A man accused of drink-driving and killing a young child on a scooter in a horrific crash will have his matter moved to a higher court to face trial.

Nicholas Alan Semler Mitaros was represented by law clark James Blanche and had his charges mentioned in the Maroochydore Magistrates Court on February 16.

Mr Semler Mitaros has been charged with dangerously operating a vehicle causing death and driving over the general alcohol limit while not owning a licence following a fatal crash that killed 12-year-old boy Dawlon Smith-Saunders at Bli Bli.

He has been additionally charged with one count of stealing, unrelated to the crash.

Dawlon was riding his scooter along David Low Way at Bli Bli when he was allegedly struck by a ute driven by Mr Semler Mitaros about 5.10pm on September 3.

He suffered critical injuries and was flown to the Queensland’s Children’s Hospital, but died two weeks later on September 17.

The charge of dangerously operating a vehicle causing death and drink driving has been committed to the district court for trial on a date yet to be decided.

He has yet to enter any pleas.

Mr Blanche said the charges were previously adjourned to review a brief of evidence.

Magistrate Matthew McLaughlin adjourned the stealing charge to March 13 for Mr Semler Mitaros to enter a plea.

Mr McLaughlin read out to the court the stealing charge related to the theft of a single bottle of wine.

“Hopefully was a good one,” he said.

Mr Semler Mitaros has been remanded in custody.
