Kane Devon Abdy refused bail on rape, indecent treatment, drug supply charges

A Sunshine Coast lawn mowing business operator charged with drug supply, indecent treatment and rape has made a second attempt at bail.

A Sunshine Coast lawn mowing business operator will remain behind bars after failing to convince a magistrate there had been a change in his circumstances.

Kane Devon Abdy appeared on video link in the Maroochydore Magistrates Court on Thursday, March 27, for a second attempt at bail.

Mr Abdy faces three charges of aggravated drug supply to a minor, one charge of assault occasioning bodily harm, dangerous operation of a vehicle and two charges of indecent treatment and rape.

Court documents state Mr Abdy supplied a child with cocaine and LSD.

Defence solicitor Jacob Pruden told the court Mr Abdy had secured an address since his first bail application, which changed his circumstances, as well as his psychological state after having a “taste of custody”.

“Prior to his bail being refused he was person who had never been in custody before, he has now been in custody for one month and 27 days, as for any person who has never been in custody before that has had an effect on his psychology,” Mr Pruden said.

Police prosecutor Sergeant Nick Nitschke said the information provided by Mr Abdy’s defence did not qualify as a change.

Sergeant Nitschke told the court police had strong evidence after a search warrant had uncovered a photo of the 39-year-old man wearing G-string underwear and posing in a bedroom, which he alleged collaborated the child’s version of events.

Maroochydore Magistrate Rod Madsen told the court the circumstances had not changed and refused Mr Abdy bail for a second time.

“I refused bail because he is an unacceptable risk of committing further offences, I said that no bail conditions would protect vulnerable members of the community,” Mr Madsen said.

Mr Abdy is expected to appear back in the Maroochydore Magistrates Court on April 7.
