The final nail has been delivered to Stockland’s Twin Waters West development application after the developer did not appeal a recent court judgment.
Planning and Environment Court judge William Everson in September dismissed an appeal by the developer over its proposal for 104ha at Pacific Paradise, Sunshine Coast.
The developer was appealing the 2020 Sunshine Coast Council decision to refuse Stockland’s development application.
The judge said there was a “real prospect of detriment or destruction” of wetland should the development go ahead.
The deadline has passed for Stockland to appeal the Planning and Environment Court’s decision.
Twin Waters West and Surrounds Inc president Kathryn Hyman said the group would “follow with interest” the developer’s next steps in regards to the land.
“We have our own prime minister saying don’t build on the flood plains,” she said.
“We’re really glad to never look at that application ever again because it was horrible.”
The proposed development was to include 584 residential allotments, community and commercial spaces and a central, saltwater lake that would pipe into the Maroochy River.
A Stockland spokeswoman said the developer continued to consider “next steps” for its Twin Waters West proposal and chose not to respond to the community group president’s comments.
