Coolum Brewing Co Pty Ltd set to take council to court
A popular Sunshine Coast brewery has argued the trading conditions enforced by the region’s council are “unreasonable”.

A popular Sunshine Coast brewery has filed legal proceedings against the region’s council over conditions to their operating hours they claim are “unreasonable”.
The company, Coolum Brewing Co Pty Ltd, which operates the microbrewery and venue at 2 Junction Drive, Coolum Beach, filed an application to appeal the Sunshine Coast Council’s decision in the Planning and Environment Court last week.
The court documents stated the brewery sought to appeal the conditions in the negotiated decision notice created last month, regarding a food and drink outlet that operates alongside the brewery.
The application was first submitted to the council in November 2023.
The court documents show the food and drink outlet is currently open seven days per week, with the latest trading hours to 11pm on Friday and Saturday nights.
However, the council’s conditions state the food and drink outlet is not able to start trading before 4pm from Monday to Thursday.
The condition is described by the brewery as “unreasonable” as they applied to begin trading on weekdays at 2pm, when the industrial section of the brewery shuts down for the day.
The brewery also argued the extended trading hours would not trigger a need for more car spaces on the site, as claimed by the council’s conditions.
“The utilisation of the existing car park compromises rational development that is consistent with the transport and parking code,” the brewery stated in the court documents.
Unallocated parking is also available on nearby “common property”, that would adequately meet the peak time crowds, the brewery argued.
According the brewery’s website the family-friendly food outlet serves burgers, tacos and sharing platters.
