Cameron James Labinsky in Maroochydore court for choking, punching girl

A kiss between two girls recorded on social media app Snapchat triggered a young labourer to brutally assault one of the girls at a Sunshine Coast house party.

A kiss between two girls at a Woombye house party resulted in jail time for a Nambour High graduate after he choked, kicked and punched one of the girls involved.

Cameron James Labinsky, now 21, was given two and a half years’ prison suspended immediately for an operational period of three years, having already served almost 12 months behind bars.

Crown prosecutor Alex Stark said a video was recorded and posted to Snapchat at 8pm of the victim kissing a girl at the party on February 26, 2021.

Labinsky saw the video and sent a message calling her friends “dirty wh---s” before driving to the party and barging through the door with his brother.

The court heard he found the victim in the hallway and pushed her hard against the wall while she attempted to break free.

“He used one of his hands to pin both her hands above her head on the wall and with the other hand started to choke her around the neck,” Mr Stark told the court.

“She felt his fingers digging in to her neck and struggled to take a breath.”

A friend of the victim sought to avoid Labinsky by running past him but he saw her, grabbed her left wrist, pulled her towards him and used a steel cap boot to stomp on her ankle.

She was unable to walk for a few days afterwards.

Mr Stark said Labinsky followed the victim into a bedroom before kicking her and punching her in the back.

“He used his hand to grip her around the throat with more pressure than in the hallway, again making it difficult for her to breathe,” he said.

The court heard a male friend managed to pull Labinsky off her.

She was taken to Nambour Hospital with back pain and bruising.

As Labinsky was leaving he punched the bedroom window causing it to smash and also pulled the letterbox out of its position.

The 21-year-old was also charged with dangerous operation of a vehicle after he was racing and crashed into a tree on Wappa Dam Rd at Kiamba near Yandina in July, 2021.

Labinsky was with a friend when they were seeing who could complete a course in the fastest time in the dark, the court heard.

The tyres on Labinsky’s vehicle started to spin, he turned a corner and slid sideways, crashing into a tree.

Labinsky had cuts to his face that required stitches and his passenger also had cuts and bruising.

The court was told Labinsky had autism and completed much of his schooling in special education units.

Defence barrister Nathan Turner said Labinsky had a close family unit and would continue living at home after being released from custody.

Mr Turner said he had entered early pleas of guilty, previously worked as a labourer and would have employment as an apprentice boilermaker if released.

Labinsky pleaded guilty to three counts of assault occasioning bodily harm, two counts of choking, one count of entering dwelling with intent in company, wilful damage and dangerous operation of a vehicle.

Judge Glen Cash said Labinky’s offending was “scary” and disqualified him from driving for six months.
