A lawyer representing a Wondai man charged with raping a three-month-old baby has told a court the man will be contesting the charges.

The man, who cannot be named due to legal reasons, is alleged to have raped a three month old baby in South Brisbane around three months ago.

The Kingaroy Magistrates Court was told on November 13 that the man’s mother tipped off police in early November and he was arrested days later.

The man’s lawyer told the court the woman who made the complaint to police was high on meth at the time and didn’t actually see the alleged abuse.

The court was told the complaint happened after the man got into a heated argument with the woman after he broke her “crack pipe” in August.

“There was a yelling and screaming argument and massive fight,” his lawyer told the court.

“He will be contesting the charges.”

The man’s lawyer said it was a weak case and the magistrate agreed.

“It can’t be described as a strong crown case,” the magistrate said.

The other charges include possession of a dangerous drug and possession of pipes and utensils connected to the drug offence.

The man was granted bail subject to a number of conditions including to only reside at his residence in Wondai, have no contact with the complainant, not apply for a passport or leave Australia, not enter an airport or leave Queensland without written permission and can only have one mobile phone with no encrypted apps.

The full brief will be heard on December, 15 2023 for the rape charge and the next hearing will be at the Brisbane Magistrates Court on January 29, 2024.

The man will face Murgon Magistrates Court on January 9, 2024 for the drug charges.
