A Burnett man busted with a stash of child abuse files has appeared in court over an illegal Snapchat account just months after being nabbed with similar accounts. Here’s why the judge extended his suspended sentence by just one day:

A Burnett man found with thousands of disturbing child abuse file has fronted court over an illegal Snapchat account, with a judge increasing his suspended term by just one day.

Robert Graham Milliken was given a two-year suspended jail in 2016 for possessing child exploitation material.

A police raid in 2015 led to the initial charges when police uncovered a laptop, USB stick, two iPhones and an iPad with 4149 examples of child exploitation material.

The most serious video featured an adult man performing sexual acts on a nine-month-old baby boy, who was tied to a bench and urinated and defecated on.

The now 38-year-old was declared a reportable offender, requiring him to report social media accounts to police.

During a compliance check in September, police discovered Milliken had an active Snapchat account which had not been reported.

He faced Murgon Magistrates Court in November 2021 for failing to declare the account, with Magistrate Andrew Sinclair noting Milliken had failed to declare the account, even when police charged him with breaches for his gaming accounts which were discovered in March of 2021.

He was sentenced to three months in jail, which was suspended for 12 months.

He was also committed to the District Court in relation to his suspended sentence.

At Milliken’s last appearance in District Court in November 2021 for resentencing over his use of the gaming accounts, the operational period of his suspended sentence was increased by three months and was due to end on February 8.

He returned to the court on the same day to be dealt with by Judge Glen Cash QC for the Snapchat account.

While Judge Cash noted Milliken had been convicted of not complying with his reporting conditions seven times, he was critical of police for not charging him for the Snapchat during the original breach investigation in March last year.

“This really should have been dealt with at the same time as everything else,” Judge Cash said.

Milliken’s operational period for his original child abuse material sentence was increased by one day, and will expire on February 9.
