Injune man caught driving after day of drinking heavy beers

A sawmill worker drank a six-pack of stubbies with his brother-in-law before getting behind the wheel, but his final destination was the courthouse.

When an Injune sawmill worker drank six stubbies of VB with his brother, he got behind the wheel and landed himself in front of the magistrate.

Xtaphar Scott Locklahn Lobegeier blew a positive breath test at 8.50pm on October 30, then he was taken to the hospital for a blood test.

Police prosecutor sergeant Heather Whiting told the court Lobegeier’s blood test contained 120mg of alcohol per 100ml of blood.

The court heard that Lobegeier told police he had drank six stubbies of VB, when they visited his home at 10am on December 1.

“It was noted that he was very cooperative with police,” sergeant Whiting said.

Lobegeier, representing himself, told the court that he was having a few beers with his brother in law and ‘didn’t really have an excuse for it.’

“I stuffed up. I take responsibility,” he said.

Magistrate Peter Saggers reminded Lobegeier that he was drinking heavy beers, which would have amounted to about eight standard drinks, before he got behind the wheel.

Lobegeier pleaded guilty to driving over the middle alcohol limit and not the high and was given a $850 fine, seven month disqualification, and a recorded conviction.

Magistrate Saggers told him not to drive for the next seven months, otherwise Lobegeier will get a two year suspension, and it will be contempt of the court order.
