Brogan John Mitchell granted bail ahead of hearing in Roma Magistrates Court next year

A ‘very high risk’ wanted man who had been on the run for more than a year has finally been located and faced Roma Magistrates court, but now he’s back in the community.

A man who had been avoiding police detection for more than a year was finally caught by Roma police, but it wasn’t long before he was back out in the community.

Brogan John Mitchell, who had been wanted on an arrest warrant since March 2021, appeared in Roma Magistrates Court on December 1 following his arrest the day prior.

Roma Magistrates Court was told police had executed a search warrant in Roma in July of last year, however Mr Mitchell escaped police and had been hiding in the Charleville and Bollon areas since.

Police prosecution described Mr Mitchell as “very high risk” of failing to appear in court as required.

“He’s gone to great lengths (to avoid detection), he provided police with a false name when spoken to yesterday (November 30),” the court was told.

“Further to his endeavours to avoid detection, he’s committed offences across three jurisdictions - Roma, Cunnamulla and Chinchilla.”

The court was told the defendant had breached bail before by failing to appear in court last year.

However, magistrate Shane Elliott granted Mr Mitchell bail with strict conditions over the Christmas break, which included daily reporting to the officer-in-charge at the Roma police station.

“It’s of course not a case that I’m determining any sentence or finding today,” Mr Elliott said.

“What I need to be satisfied of today for bail is that the risk of you committing an offence or failing to appear can be mitigated to an acceptable level.

“In my view, the strict conditions reduces the risk of you committing an offence or failing to appear.

“Take this warning Mr Mitchell, I’ve given this warning to many and not everyone’s followed it.

“If you breach my bail conditions, it would be a wasted breath to apply for bail, it will be refused.

“Don’t think it’s an empty threat, it is not.

“I’m giving you a chance, just know that if you miss a day of reporting, you’re going in (custody).”

Mitchell is due to face Roma Magistrates Court on January 17 for sentencing.
