Leanne Wilson pleads guilty in Roma Magistrates Court to drug driving despite claiming her tea was ‘spiked’

A 58-year-old woman claimed in court the only reason she was drug driving was because ‘unwanted’ house guests had spiked her tea.

Should Cannabis be legal in Australia?

A woman with no history of drug driving has told a court the reason she was caught by Roma police with drugs in her system was because her drink was spiked by unwelcome guests at her home.

Leanne Wilson pleaded guilty in Roma Magistrates Court on Wednesday November 30 to one charge of drug driving.

On September 30, police intercepted a Toyota SUV on the Carnarvon Highway, Roma for a random alcohol and drug test.

The court was told Wilson, who was the driver, denied any drug use, however, saliva swabs revealed Wilson had traces of cannabis and methamphetamine in her system.

Appearing before a magistrate, the 58-year-old woman told the court the incident was “my mistake regardless”, despite claiming her drink was spiked by unwelcome guests at her home.

“She tells me, your honour, that she had some unwanted visitors who were quite intimidating and poured some milk over where she was residing,” Wilson’s lawyer Laurie Parker said.

“She made them a cup of tea and that was how she ingested the drugs in question.”

Upon hearing this, magistrate Shane Elliott said “shouldn’t be pleading guilty if she didn’t know and someone has spiked her drink”.

Mr Parker said his client accepted the blame because she still chose to drive the vehicle and wished to finalise the matter.

Mr Elliott noted that while Wilson had a history of drink driving, she had no drug driving history and fined her $400 fine as well as disqualifying her licence for two months.
