Yeppoon resident Melissa Jane Dingle pleaded guilty to assaulting her neighbour

A Yeppoon woman has faced court for assaulting her neighbour - something she claimed was the result of being on the receiving end of “ongoing bullying”.

Melissa Jane Dingle, 50, pleaded guilty in Yeppoon Magistrates Court on March 10 to common assault.

The court heard the assault victim was Dingle’s neighbour and that they had been neighbours at Lammermoor for just over a year but had known each other longer.

Police Prosecutor Stacey Bain said that on December 10 last year, about 11.30pm, the victim was inside her kitchen when she overheard Dingle having an argument with her roommate.

Ms Bain said the victim and Dingle then got into a verbal argument over the fence that separates their properties.

Ms Bain said Dingle then told the victim “to sort it out at the front” and that was when the victim disengaged and went to her bedroom to get changed.

“(Dingle) has walked from her address, up the driveway of the victim’s address and entered the victim’s house,” Ms Bain said.

Dingle continued to yell at the victim and the victim took out her phone to try and film this.

But Dingle snatched the phone from her.

The victim grabbed her phone back and both women ended up on the balcony.

Ms Bain said the victim tried to get back inside when Dingle tipped the contents of an open beer stubbie onto her.

Police were called to attend in relation to the disturbance.

When they arrived, Dingle was not at the victim’s residence.

The court heard that Dingle had a one-page criminal history.

Representing herself in court, Dingle told Magistrate Cameron Press this had been “an ongoing bullying matter for at least five to six months”.

“Listening to private conversations - the comments have been extreme, very harsh,” Dingle said.

“And I’ve tried my hardest not to retaliate but it’s been an ongoing thing.”

Mr Press told Dingle that she could not retaliate with physical violence and he asked her what she was going to do about the ongoing problem.

Dingle said she was moving out in the next three weeks.

Mr Press fined Dingle $800.

A conviction was recorded.
