A man charged with torture and deprivation of liberty from an alleged from September 2019 has had his trial delayed time and time again has been told there will be no more adjournments.

A man charged with torture and deprivation of liberty over an alleged incident from September 2019 who has had his trial delayed time and time again has been told there will be no more adjournments.

Walid Hasaneen, 52, was charged with one count each of torture and deprivation of liberty, along with two counts of assault occasioning bodily harm – one while armed or in company – and three of common assault after an alleged incident on September 16, 2018 in Gladstone.

It was alleged Mr Hasaneen had driven from South Australia to “surprise” his wife of 26 years who had moved to the Central Queensland town for work.

Police allege Mr Hasaneen subjected his wife to nine hours of torture; punching, slapping and using a knife on her.

The Rockhampton District Court heard on March 18, 2022, that Mr Hasaneen’s matters had been listed for trial three times, he had gone through five different legal representatives and made 30 applications to courts since being charged in 2018 and the indictment presentation in July 2019.

One of the legal representatives had withdrawn as they were not available for a previously set trial start date.

The latest trial date had been March 21, 2022, however, an email on March 17 late in the afternoon stated there had been a misunderstanding and legal representatives had thought the trial was not starting until after April and this month’s date was a pre-trial mention.

The court also heard there had been four subpoenas and many applications over the years regarding Egyptian medical records.

Crown prosecutor Tiffany Lawrence said the crown’s case was expected to take one day with three witnesses and CCTV footage.

The court, however, was told the cross examination would lead the trial to taking five to six days.

Judge Jeff Clarke said he was initially considering rejecting the application to delist the trial due to the amount of “false starts” in this case.

However, he allowed one more adjournment and relisted the trial to start on June 13, 2022, due to the defendant’s current legal representative being booked to appear in another city’s court this week and other logistics required to run the trial in Rockhampton.

“It will not be adjourned again,” Judge Clarke said.
