Senior Constable Rowe said about 2km from Blackwater, police saw the vehicle travelling westbound and swerving into each side of the road behind another vehicle.

She said Kehl told police he was driving from his home in Bouldercombe to camp in Blackwater and that he had had a couple of drinks of beer at home before he left.

Defence lawyer Emma Locke said the offence had made her client realise he did have a significant issue with alcohol that was in urgent need of addressing.

Ms Locke said Kehl, who worked in the mining industry as a multiskilled operator, had engaged with a number of counselling and alcohol services, including the Rockhampton Alcohol and Other Drugs Service.

Kehl was fined $1200 and disqualified from driving for nine months.

At the time, Van Vegten was subject to a zero alcohol limit and she was required to have an interlock device fitted to her vehicle.

A solicitor said Van Vegten, who worked in the disability support sector, had not been able to afford an interlock device and she wrongly thought she was subject to the .050 blood alcohol limit.
