Meth using DV offender threatens to rape partner, her kids and mother

A domestic violence offender who threatened to rape his partner, her children and her mother, told the woman he was “the devil.”

The 25-year-old offender, who cannot be named for legal reasons, pleaded guilty on June 27 in Rockhampton Magistrates Court to two counts of breaching a domestic violence order.

Both offences occurred in North Rockhampton on June 3.

Police prosecutor Courtney Brown said the charges included serious threats to the female victim, while the man was on parole for an attempted choking and common assault for which he was sentenced in Gladstone District Court to two years’ prison.

Magistrate Jason Schubert said this was “some of the most serious threats, the most specific threats, that I’ve read in this job”.

Mr Schubert said one the messages the defendant sent the victim, read: “You better lock your doors.

Me and my crew are coming for you, you s---. Rape you, and your mother, and ya kids, and you, you mother f---er.

“I swear to God up in heaven I’m telling you mother f---er, I’ll come to town and kill you babe.”

Mr Schubert said the messages then went on with the man alleging the victim had cheated on him with two men.

“Trust me, you f---ed with my heart, you little maggot, it’s over. You dead, you mother f---,” the messages read.

“If I don’t get you, I’m gonna get your sister.

“She’s dead.

“She works at the pub.

“All my boys are going to be watching her, you mother f---er.

“I’m telling you… I’m the devil… I’m going to kill one of your kids, if I don’t get you.”

The court heard the threats continued, including “a price on your head for the rest of your life now.”

Mr Schubert described the messages as “some of the most specific, disgusting, threatening, cowardly” messages he had seen.

“You should hang your head in shame,” he said as the defendant groaned and hung his head.

“You’re a real risk to the community.

Prosecutor Brown said: “It is concerning that after being subject to quite a serious sentence, he just hasn’t gotten the message about domestic violence.”

Ms Brown said the man’s criminal record, which was six-pages, started when he was 18 and included convictions for serious assault of a person over 60, drugs and going armed to cause fear.

Defence lawyer Rebecca Winning said her client had been in a relationship with the victim but he had instructed that relationship was over.

She said her client claimed the victim had cheated on him.

“He was also under the influence of ice at the time, which does not excuse his actions but does provide context,” Ms Winning said.

Mr Schubert sentenced the man to four months’ prison, declared 20 days pre-sentence custody, and set parole eligibility for June 27, 2022.
