Meth user Elsie Zipporah Destiny Whap, 26, gets jail sentence for 30 offences

A meth-using mother who “got into the drug scene heavily” has been given a jail sentence for 30 offences including fraud and an assault occasioning bodily harm charge involving her partner.

Elsie Zipporah Destiny Whap, 26, pleaded guilty on July 8 in Rockhampton Magistrates Court to 30 charges including 12 breaches of bail, nine fraud - dishonest use, one assault occasioning bodily harm, two fail to properly dispose of a syringe/needle, one trespass and one attempt to enter premises with intent to commit an indictable offence.

Police prosecutor Clancy Fox said Whap and the AOBH victim, 55, were having a verbal argument over owed money on February 12, 2022, at Allenstown, when Whap became agitated and started damaging the victim’s property.

“The victim asked the defendant to stop and to leave, but the defendant continued her behaviour and the victim then offered physical violence first to the defendant,” Mr Fox said.

“Placing the defendant in a headlock in an attempt to stop her from damaging the property to give her time to calm down.

“And it was while she was in a headlock that she’d bit down on the victim’s left hand, pierced the skin and drawing blood.

“The victim then let go of the defendant … and noticed teeth marks on their finger.”

Mr Fox said the victim tried to leave the dwelling through the kitchen but Whap pushed him many times, trying to push his head towards glass.

Mr Fox said the victim managed to move away from the glass, but hit his head on a cupboard.

He said the victim then told Whap this was “the last time anyone would see” Whap if she called police.

The pair separated when one went to the hospital.

Defence lawyer Rebecca Winning said Whap, a mother of one, had been in an intimate relationship prior to the incident and the victim had allegedly been “quite emotionally abusive” towards Whap.

She said Whap, who “got into the drug scene heavily” two years ago after her grandfather’s death, was on ice (methamphetamines was her drug of choice) at the time of the offence and “she had enough, she snapped”.

Ms Winning said that relationship had ended.

Ms Winning said the 68 days in pre-sentence custody was the first time Whap had spent time in custody, she had been drug free since being incarcerated, and wanted to continue her rehabilitation.

“She’s been able to get away and she’s been able to detox,” Ms Winning said.

Magistrate Philippa Beckinsale warned Whap the minute she “goes down the path of using a drug, or even associating with people that use drugs” she was “in danger of going down that slippery slope again” and looking at time in prison again.

Ms Beckinsale said she imagined Whap’s grandfather would be sad that Whap’s drug lifesytle was linked to his death.

“It’s no way to live your life,” Ms Beckinsale said.

She sentenced Whap to nine months’ prison, declared the pre-sentence custody as time served and gave her immediate release on parole.

Convictions were recorded.
