Joel Ian Rodney Moore who threatened to kill his partner arrested enroute to job in Mackay

A man yelled at his partner “I’m going to kill you” before lunging at her with an abattoir knife as she ran towards his mother for protection.

Joel Ian Rodney Moore, 32, pleaded guilty in Rockhampton Magistrates Court on August 26 to one count each of common assault and breaching a protection order.

Police prosecutor Clancy Fox said the couple was arguing about other matters when Moore yelled “I’m going to kill you, you lying little c---” at the victim.

He said the victim told Moore to leave to which he laughed and said “I don’t need to leave. This is my house”.

Mr Fox said the victim began packing her belongings into her vehicle so that she could leave with the children.

He said the victim contacted Moore’s mother for assistance.

Mr Fox said the victim was trying to walk from an internal garage door to a vehicle when Moore stood in her way, blocking her access to the vehicle, however, she did eventually manage to pack her vehicle.

He said as the victim called the police, Moore ran to a toolbox and removed a knife which was described as “an abattoir knife”.

Mr Fox said Moore then lunged at the victim with the knife in his hand.

He said the victim ran around the vehicle in order to escape, looking back a few times to see Moore swinging the knife towards her.

Mr Fox said the victim fled to Moore’s mother, who had arrived, and Moore told his mother “shut up Mum or I’ll kill you too”.

He said the victim’s friend arrived and the victim left with the friend.

Defence lawyer Kelsea Read said her client sustained a brain injury after jumping out of a moving vehicle in a suicide attempt in 2014.

She said the resulting brain injury was “such that he does not have the ability to properly regulate emotions, particularly when dealing with heightened situations or in states of arguments”.

“Of course, it can provide no excuse, but does provide context,” Ms Read said.

“He does receive ongoing treatment and counselling for his brain acquired injury.”

She said the breakdown of the relationship was the catalyst in this offending.

Ms Read said Moore was en route to Mackay to work at Paget, with the job starting on August 27 and running for four weeks, when he was intercepted by police over this incident.

Magistrate Philippa Beckinsale sentenced Moore to nine months prison with immediate parole.

Convictions were recorded.
