A man involved in an ice throwing incident at a popular cafe claims he was coward punched, resulting in a disturbance at a Yeppoon nightspot.

Isaac Anthony George, 37, pleaded guilty in Yeppoon Magistrates Court on March 30 to two counts of public nuisance in the vicinity of licensed premises, and obstructing police in public while intoxicated.

Police prosecutor Brandon Selic said about 9.45pm on March 11, George entered The Alley cafe, a licensed premises, on Yeppoon’s Normanby Street.

Mr Selic said while George was there, he approached a group of patrons seated in an outside area.

Mr Selic said George tried to start a conversation with a woman in that group before he was asked to leave.

The prosecutor said George then picked up ice and threw it in the direction of the group.

Mr Selic said George was on the footpath when he yelled out to other men and gestured for them to come out and fight.

The court heard the incident occurred for about five minutes before George started walking towards The Strand Hotel.

Mr Selic said about 9.55pm, police found George outside The Strand Hotel and they saw he was intoxicated.

The court heard when police tried to speak with George, he immediately became hostile and verbally abused them.

Mr Selic said police gave George multiple opportunities to engage with them before he was arrested for public nuisance.

Mr Selic said after George was arrested, he was involved in a struggle with police and he had to be transitioned to the ground.

The court heard George had a one-page criminal history with a relevant entry but it was “significantly dated”.

The prosecution sought a banning order from The Alley cafe and The Strand Hotel.

A self represented George told Magistrate Cameron Press he had reacted to being coward punched at the cafe and he was not a violent person.

George accepted he had caused a disturbance.

Mr Press fined him $900 and ordered he perform 50 hours of unpaid community service.

Mr Press did not impose a banning order.

Convictions were not recorded.
