Full brief of evidence will not be ready before February 2022 in the Catling alleged murder case

A Central Queensland alleged murder case from March 2021 will not be before the higher courts until mid next year.

Kerrie Lee Catling was charged in August with the murder of Chris Catling, 51, who died on March 22, as a result of a single stab wound by a knife to his chest.

An update on the case was provided in Rockhampton Magistrates Court on November 11.

Rockhampton solicitor Grant Cagney, who acted as town agent for Jacobson Mahony Lawyers who have been engaged by Ms Catling, told the court Magistrate Jason Schubert had previously ordered police prosecution to present what evidence they had so far.

“That has come in today,” Mr Cagney said.

He said the outstanding material was expected to be presented “not before February 2022”.

Mr Cagney said the defence team did not want to adjourn Ms Catlings matters “for that long”.

He said there were other statements and material that were expected towards the end of November and the start of December.

Mr Cagney asked the matter be adjourned until early December and police can update at that time.

Magistrate Cameron Press did not agree with Mr Cagney, saying he could not see why the matter should keep being mentioned.

He adjourned Ms Catling’s charges until January 20, 2022.

During a bail application in the Supreme Court in October, the court heard police received two triple-0 calls on the day of the alleged murder, the first from a male, with a female voice heard in the background, before it was terminated.

A second triple-0 call was made by Ms Catling nine minutes later.

Police who responded found Mr Catling unresponsive in a lounge chair in the couple’s North Rockhampton home, with a knife on the ground near his right hand.

He had no defensive wounds, the court heard.

Justice David Boddice said it was alleged the downward trajectory of the knife went from the top of the chest into Mr Catling’s heart, with the wound 12 centimetres deep.

Ms Catling was denied bail on that occasion and remains remanded in custody.
