Elwyn Tilberoo sentenced after fight outside Pacific Hotel, Yeppoon

A man was knocked unconscious and fell to the ground, with his head hitting the concrete, during a violent fight outside a Central Queensland pub - now the details about what was said can be revealed.

Elwyn Carl Tilberoo has been banned from all licensed premises at Yeppoon after an ugly incident outside the Pacific Hotel.

On the night of April 4, Tilberoo was standing on the footpath directly outside the hotel when he had a brief interaction with a male patron leaving the venue.

Tilberoo then took up a “fighting stance” and with his fists raised to his chest, started walking towards the other man.

The other man shuffled backwards and Tilberoo threw a right-handed punch towards his face - it narrowly missed connecting.

The other man took a few steps back to try and get away from Tilberoo but Tilberoo then lunged at him a second time.

Tilberoo threw another right-handed punch which connected with the man’s chest, followed by a left which connected with his cheek.

As a result of the facial blow, the man was knocked unconscious and fell to the ground with his head hitting the concrete.

While the man lay unconscious on the ground, Tilberoo “threw a kick with his right leg” - narrowly missing his head.

Police arrived shortly after to see about 50 members of the public in the area and they arrested Tilberoo.

Tilberoo, 23, accepted that version of events in Yeppoon Magistrates Court where he pleaded guilty to public nuisance in the vicinity of licensed premises.

After those facts were read by police prosecutor Claudia Neill-Ballantine, Magistrate Philippa Beckinsale asked if there were no other charges arising out of this incident.

Ms Neill-Ballantine replied: “No, the patron did not wish to make an assault complaint.”

Tilberoo had no criminal history and the prosecution sought a banning order from all licensed premises at Yeppoon for 12 months.

A solicitor said the male patron who Tilberoo attacked had racially insulted him.

The solicitor said as Tilberoo had no criminal history, a fine would be in range.

During sentencing, Magistrate Philippa Beckinsale said Tilberoo’s behaviour was “disgusting” and it was also disgusting that the other person involved had used racial abuse.

“It (racial abuse) makes people angry and I accept that you were angry but you cannot, you’re doing the wrong thing (reacting with violence).

“You can’t solve these people by physical means - you cannot enter into a punch up.

“You’re the one here, in trouble.

“I’m not offering any excuses for the victim, but you could have killed a person when someone hits their head on the concrete, and then you’re up on a different sort of charge and you’re the one that ends up in jail.

“So please try not to solve things in this way ever again.”

Ms Beckinsale fined Tilberoo $1000 and banned him from all licensed premises in Yeppoon for 12 months.

No conviction was recorded.
