A man with a 31-page criminal record, starting in 1997 and continuing almost every year, claimed during a bail application that he didn’t assault his partner or threaten to kill her.

David Russell Morris Platt, 42, has been charged with assault occasioning bodily harm and other charges following an alleged assault where the victim was struck with a plastic crate while on the ground.

Police prosecutor Sergeant Kevin Ongheen said the allegations involved the attempted use of violence, the threat of violence and actual violence, all committed while on bail for wilful damage.

He said it was alleged the defendant and victim were “reading a book together” when Platt has “suddenly gone off”.

Sergeant Ongheen said Platt was accused of yelling at the victim and punching her in the mouth.

“The defendant then placed both hands around the victim’s neck, squeezed his hands and then threw the aggrieved down to the ground,” he said.

Sergeant Ongheen said the victim allegedly fell on her elbow.

He said the defendant was further accused of picking up a plastic crate and hitting her twice with it while she was on the ground.

He said the victim then attempted to stand back up and Platt allegedly placed his hands around her neck again, while saying something along the lines of “if you go with another man, I’ll kill you”.

Sergeant Ongheen said the victim fled after Platt allegedly released his grip.

He said she was taken to hospital immediately with a laceration to her elbow and a split, swollen lip.

Defence lawyer Rebecca Winning said her client, who concedes he has an unenviable criminal record, claims he did not assault the alleged victim.

She said he claims the victim invited him over and they were both drinking alcohol.

Ms Winning argued Platt would be at risk of spending too much time in custody on top of the time he spent in the watch house and in police custody while being treated in hospital for alcohol withdrawal before the bail application.

Magistrate Philippa Beckinsale said Platt’s criminal record had convictions every year since 1997, except for 2018.

She refused to grant Platt bail, he was remanded in custody and his matters were adjourned for six weeks with briefs of evidence ordered.
