A Rockhampton man assaulted a woman, striking her in the head with a can, and accused her of sleeping with someone else.

A Rockhampton man assaulted a woman, striking her in the head with a can, and accused her of sleeping with someone else.

David Marshall John Richards, 28, pleaded guilty in Rockhampton Magistrates Court on June 28 to one count of assault occasioning bodily harm.

Police prosecutor Clancy Fox said Richards was drinking alcohol in the garage at his home in Berserker on June 18 when he started yelling at a woman, calling her a “dog” and throwing an empty glass beer bottle at her head, which narrowly missed her.

Mr Fox said Richards continued to yell at the woman and that she said she would call the police.

He said Richards pushed the woman in the chest and that as she turned around he struck her in the head with a can, which caused her some pain and bruising the next morning.

He said Richards accused the woman of sleeping with another person and pushed her another three to four times.

Mr Fox said the offending breached a suspended sentence.

Defence lawyer Brendan Gimbert said his client, who had three children, was intoxicated at the time of the offending.

“He instructed there was arguing back and forth between the two and some pretty nasty comments were made,” Mr Gimbert said.

“That relationship is now over.”

Magistrate Cameron Press sentenced Richards to 12 months’ prison with parole release on October 27.

Mr Press extended the suspended sentence that was imposed in a Rockhampton court on January 2 for three months.
