Damon Noel James Hudson charged over alleged Allenstown home invasion

A former house painter, previously jailed for stashing large amounts of marijuana for the mother of his children while she ran a drug trafficking business, has been remanded in custody after birthday drinks led to a sobering experience.

A father-of-two previously jailed for stashing large amounts of marijuana for the mother of his children while she ran a drug trafficking business has been remanded in custody - this time for an alleged home invasion, possibly on the wrong house.

Damon Noel James Hudson, 29, has been charged with one count each of entering a dwelling by break at night while in company and wilful damage after the alleged incident on September 15.

Magistrate Cameron Press said it was alleged Mr Hudson, on his birthday, with three co-accused attended a Ross Street, Allenstown, residence while armed.

He said Mr Hudson was allegedly armed with a fence paling while one of his co-accused was armed with poly pipe.

Mr Press said it was alleged that Mr Hudson called out a man’s name to come out of the dwelling and others made threats “peppered with numerous offensive aggressive words” such as “I’m going to run through your house and f**k your mother unless you come out and fight like a f**king man”.

He said one of the other offenders allegedly damaged a window with the poly pipe while Mr Hudson used his body to force entry into the dwelling, damaging the locking mechanism.

Mr Press said Mr Hudson is accused of further damage to an internal door to the left of the front door before fleeing the residence.

“There is CCTV footage,” he said.

“The evidence here is strong.

“It may well be that the defendant has gone to the wrong address because the victims do not know the defendant.”

Defence lawyer Felicity Davis said Mr Hudson had been drinking alcohol which contributed to the offending.

She said the father of two, who has both children in his care while living with his mother, had been working as a house painter at Yeppoon prior to this incident.

Police prosecutor Claudia Neill-Ballantine said Mr Hudson had a “deplorable criminal record” and had a history of breaching court orders and propensity for violence.

Mr Press said in May 2022 Mr Hudson was sentenced in the Rockhampton District Court for drug related charges and that he would likely face time in prison for this alleged offending.

Mr Press found bail conditions would not manage Mr Hudson’s risk he posed and denied him bail.

A brief of evidence was ordered.

Mr Hudson was remanded in custody and his matters were adjourned to November 13.
