A mine worker dad secretly sent saucy images of sex acts with his wife in a Facebook chat. Now, he’s ended up in court.

A miner who shared intimate images of his ex-wife and a shocking video of himself via Facebook Messenger has not had convictions recorded for these crimes but must pay her compensation.

The 42-year-old sent intimate images of his former wife and other women dressed in BDSM (bondage, discipline, sadism, masochism) clothing to others on the social media platform, Rockhampton Magistrates Court heard on September 11.

Police prosecutor Mirren Smith said the pictures were shown to two women in a chat to show “what he had done with the women in the pictures in the context of suggesting that he would like to do the same consensual things with the women in the chat”.

She said he also sent a video of himself carrying out a sexual act with his wife in the video, with one of the women in the chat commenting that he “should not have done that and that she could not consent if she was asleep”.

Ms Smith said the man sent the video earlier this year.

“It is a disgusting act to do against his ex-wife,” she said.

“The victim was unaware of the defendant’s activity and had not given permission to him to distribute the intimate images,” she said.

The man, who was previously a registered firearms owner, had been busted weeks prior with two rifles left on a mattress in a bedroom, not secured and next to magazines with ammunition in the same bag.

Defence lawyer Myles Heath said the messages were sent in the context of a relationship separation and accepted his client “should not have sent (the images).

Mr Heath said regarding the weapons, the Warwick-born machine operator had just moved house and had done the wrong thing by not instantly securely storing them.

He said the father’s criminal history was quite dated and unrelated.

Magistrate Cameron Press told the man that had an intimate image of himself been distributed, he would have been quite offended.

“One would have thought that the correct thing to do is to delete any such image,” he said.

The man pleaded guilty to one count of distributing an intimate image of another person and one count of failing to safely secure firearms.

Mr Press placed him on 15-months' probation and ordered him to pay $1500 compensation to the victim and as well as a $600 fine for the firearms offence.

No convictions were recorded.
