Disability carer Alison Leigh Whyte jailed for assault on de facto at Biloela

A Queensland woman who once stabbed a man has now been jailed for attacking the disabled partner she was being paid by the government to care for.

Alison Leigh Whyte, 46, was in a relationship with the victim and receiving a carer’s payment from Centrelink when she struck him in the head with an electrical extension cord in Biloela on April 1, 2023, Rockhampton District Court heard this week.

Crown Prosecutor Monique Bros-Wilshire said the pair had been in a verbal argument prior to Whyte’s attack on the man, who had an acquired brain injury, speech impediment and had been diagnosed with schizophrenia.

The court heard the man sustained a Y-shaped wound and a 4cm-long lineal laceration to the back of his head, which bled significantly.

Judge Jeff Clarke said the victim grabbed paper towels from the kitchen “to staunch the blood flowing from him”.

The victim yelled for help which the neighbours heard and called police.

He was taken to Biloela Hospital, and then Rockhampton Hospital, and his wounds were stitched up.

Ms Bros-Wilshire said Whyte told police the victim had injured her finger a week earlier.

She said Whyte breached two suspended sentences with this offence – one for hitting this victim in the head and kicking him for which she was given a 10-month prison term operational for 30 months.

The court heard background information about this relationship included an NDIS worker hearing Whyte verbally abused the victim while the worker was on a call to the victim, with Whyte saying to the man: “How can you f***ing do this to me? F*** you. You are going to pay for this.”

She had also been hitting him daily for many months.

Ms Bros-Wilshire said Whyte’s criminal record contained convictions for violence against others, including throwing a saucepan at the back of one before attacking their chest with a kitchen knife, causing minor wounds, before stabbing them in the arm and causing a deep laceration.

Defence barrister Jordan Ahlstrand said his client lost one of her three children in 2021, and was a grandmother of five.

He said she was using marijuana and abusing alcohol at the time of the offending.

Mr Ahlstrand provided tests to the court showing Whyte was now clean of drugs and alcohol.

He also provided documents to show she was on a mental health plan guided by her doctor.

The court heard the victim has relocated out of Biloela and into an assisted living facility.

Whyte pleaded guilty to one count of assault occasioning bodily harm while armed.

Judge Clarke sentenced Whyte to 2.5 years prison with her two suspended sentences activated in full and served alongside the AOBH term, declared 146 days presentence custody as time served and released on parole immediately.
