Man who threw beer can at car after trespasser scare walks free from court

A man has found himself in court after chasing an intruder out of his backyard and throwing a beer can at a car.

A Rockhampton man who threw a beer can at a vehicle which had people in it who he believed had broken into his yard has walked out of court scot-free.

Greggory Noel McIntosh pleaded guilty at Rockhampton Magistrates Court on Thursday to one count of wilful damage of a motor vehicle.

The court heard that on June 19, 2025, at 5.55pm a person he didn’t know entered his backyard before McIntosh’s dogs chased the unknown person out of the Rockhampton property.

Police prosecutor Claudia Neill-Ballantine said McIntosh followed his dogs to a vehicle parked across the road.

“The defendant has attempted to open the door to the driver’s side. The defendant then attempted to open the passenger door,” Ms Neill-Ballantine said.

McIntosh yelled at the occupants: “Get the f**k away from my house”.

As the vehicle drove off, McIntosh, who admitted he had been drinking, threw a beer can at the vehicle, causing a large dent.

The court heard McIntosh has no criminal history and a request for $1605 in restitution was made for damage to the vehicle.

It was not alleged that the owner of the vehicle was the person in McIntosh’s yard.

Representing himself, McIntosh said the person he chased was possibly in their late teens or early 20s.

Acting Magistrate Stephen Byrne said McIntosh’s frustration was understandable, but his reaction wasn’t ideal.

“The community is sick and tired of people breaking into houses and breaking into yards,” he said.

“Situations like this can escalate and there’d be better ways to handle the situation.

“In the circumstances, I’m not going to punish you.”

No conviction was recorded.
