Noosa Council considers legal action against hinterland ‘party house’

Legal action could be taken against a Noosa hinterland “party house” owner who allegedly continued to rent the property for short stays without relevant approvals.

Noosa Council is considering taking the matter to the Planning and Environment Court after receiving complaints from neighbouring residents about the Amaroo Pl, Cooroibah property.

The council refused the owner’s request for short term accommodation in 2021.

Another application had been lodged under the council’s new local law for holiday homes and units but it was yet to be decided.

According to the council police have been called on multiple occasions to the property which is listed for rent for up to $2500 a night.

In September, 2021 the property made headlines after neighbours complained that up to 33 cars, tents and motorhomes were spotted on the hinterland block.

Councillors will vote on the next steps at Thursday night’s ordinary meeting with a recommendation to send a final notice to the Brisbane-based owner before taking the matter to the Planning and Environment Court.

The move was revealed in the council’s meeting agenda.

As of Wednesday afternoon the property was no longer listed on Airbnb or taking bookings via Booking.com.

However an Instagram page and website was still live as of Thursday afternoon where it was described as one of the few properties in the area that could accommodate “so many people in comfort and style”.

The council claimed the property was rented out for groups of more than 17 people.

It had a rating of 4.84 on Airbnb.

Council development assessment manager Kerri Coyle said ongoing complaints were received from nearby residents in the cul-de-sac street with some describing it as a “party house”.

The Daily has attempted to contact the owner.

“The property has been offered for short term accommodation on an ongoing basis, accommodating at least 17 persons on site at times within the existing dwelling and stables,” Ms Coyle said.

“Amaroo Place is a quiet cul-de-sac, serving a limited number of residents with the Great Sandy National Park located to the site’s northeast and so noise from guests staying/partying on site is very audible to residents in the area.”

Ms Coyle said a final letter would be sent to put the owner on notice that the council would take the matter to court if they continued to use the house as short stay accommodation.

She said the council had statements from nearby residents, proof of advertisement of the property on Airbnb and police reports.
