Scott Ronald Keith Kay pleads guilty to kicking mate in testicles

An argument between two mates resulted in one kicking the other in the testicles, but there was a bizarre twist linked to the injury.

An argument between two mates resulted in one kicking the other in the testicles with the injury bizarrely revealing a serious underlying health condition.

The blow ruptured the victim’s testicles and as a result Scott Ronald Keith Kay was initially charged with causing grievous bodily harm.

But Mackay Magistrates Court heard the victim had an underlying health condition and his testicles would have ruptured regardless as a result of an infection.

The incident occurred on March 3, 2022 at the Ozcare Men’s Hostel on Endeavour St.

Kay and the other man, who were both residing at the short-term accommodation, had an argument.

Prosecutor Sergeant Paul Cramp said Kay went to his own room but returned and the victim stood at the end of his bed “to work out what was happening”.

The court heard at this point Kay lashed out striking the victim in the testicles.

Sergeant Cramp said the victim had an underlying health condition which came to light following the assault.

“But the health condition was not the cause of Mr Kay,” Sergeant Cramp said.

Kay, 24, pleaded guilty to common assault. The grievous bodily harm charge was dropped.

Legal Aid Queensland solicitor Danny Yarrow said his client was not currently working but had an interview to be a trolley pusher.

“He and the victim were friends prior to this, they’re not friends anymore,” Mr Yarrow said.

The court heard Kay had been living at the hostel while looking for accommodation.

Magistrate Damien Dwyer said despite Kay’s criminal history, violence was out of character.

“This is not you Mr Kay, you’ve come to see me a lot … but you don’t normally resort to this,” Mr Dwyer said.

Kay was fined $1000 and ordered to pay $700 compensation to the victim.

A conviction was not recorded.
