A Sarina mother of six verbally abused police and paramedics during a drunken episode outside a pub.
Melissa Joy Delaney, 46, had been sitting on Central St outside Tandara Hotel in Sarina on December 10 when she threw her bag and tried to kick at police officers.
She then blew 0.245 on an alcohol breath test and later pleaded guilty to obstructing a police officer.
Delaney was also charged with intoxication in a public place but police prosecutor Leonie Taufa’ao offered no evidence and the charge was struck out.
“Initial information (said) there was a female outside the property, possibly covered in urine, non-responsive but breathing,” Ms Taufa’ao told Mackay Magistrates Court on January 19.
“Police attended (and) were aware of (Delaney) from previous dealings.
“(Delaney) became verbally abusive, then threw her bag at police and started to walk away.
“(She) pushed back on police as they attempted to get her into the (police) vehicle and attempted to kick them.”
The court heard paramedics were called to the pub after Delaney vomited and offered to take her to hospital but she refused.
Defence lawyer Geoff Govey said one of Delaney’s six children had been “extremely abusive” towards her earlier that day.
“It’s not an excuse of course, but it is background context,” Mr Govey said.
He said while Delaney had a history with public drunkenness, her last criminal charge was eight years ago.
Magistrate Bronwyn Hartigan said Delaney’s criminal history was “a bit old now”.
“It suggests she’s a bit of a nuisance out and about, and that she might have trouble controlling herself when she’s drinking,” Ms Hartigan said.
“There was no violence as such to police, you’re just making their job more difficult because you didn't want to go with them.”
Delaney was sentenced to 40 hours community service with no conviction recorded.
