Marianto Marianto pleads guilty to indecent assault on Hamilton Island

A man who ignored a woman’s rejection of his sexual advances after a party on Hamilton Island has been ordered to pay her compensation in an ‘expression of his remorse’.

A man who indecently assaulted a woman inside her apartment after a party on Hamilton Island will pay her compensation as an “expression of his remorse”.

Marianto Marianto and the woman had been at a party on the island in 2021 when she invited the 24 year old back to her apartment to watch TV with her male roommate.

Mackay District Court heard because of the size of the room, she invited Marianto to sit on her bed so he could see the television.

“He then placed his right hand on her upper left thigh and slid his hand upwards,” Crown prosecutor Caitlin Penfold said.

She told the court Marianto touched the woman over and under her clothes before the woman grabbed his wrist and pulled it away.

“The complainant then loudly announced to the room she was going to sleep,” Ms Penfold said.

The court heard Marianto spooned the woman and asked her if she wanted to have sex, to which she said no.

The woman then moved into her roommate’s bed.

Marianto pleaded guilty to four counts of indecent assault.

Marianto’s barrister Matt Heelan QC told the court his client’s early pleas and apologies were evidence of his remorse.

“My client instructs that this matter has weighed heavily on him,” Mr Heelan said.

“He is extremely remorseful.”

Mr Heelan said his client’s offer of compensation was the maximum of what he could afford.

“It can’t be that offenders can buy their way out of jail,” he said.

“That (compensation) really is just an expression of his remorse.”

Judge Tony Moynihan QC sentenced Marianto to 18 months jail, suspended for two years with immediate parole.
