A drunk punter has been banned from the Mackay CBD after she tried to slap nightclub worker across the face and later kept trying to undress herself in police custody.

Harley-Rose Dorothy Winn had struggled with alcohol “most of her life”, but her use had recently spiralled after her sister suffered a brain injury.

Mackay Magistrates Court heard Rabbit Hole security called police about 1am on June 28, 2024 after a woman“assaulted a female staff member”.

As a result, officers took up with Winn, who “denied anything having happened” but appeared to be affected by alcohol, prosecutor Sergeant Hannah Beaumont said.

The worker told police Winn had “tried to slap her … and security had intervened to stop the assault from occurring”.

The court heard Winn’s fingers had made contact with the worker’s face but she did not want to make an assault complaint.

After reviewing CCTV footage police determined it was a public nuisance offence.

Winn was arrested and taken to the watch house about 1.25am and during a pat-down search she “started to undress herself”.

The court heard she was told multiple times to keep her clothes on during the pat-down search, but she continued to try and take off her upper clothing prompting police to have to use open hand tactics to control her arms and hands.

The court also heard about 11.30pm May 12, 2024, police gave Winn a notice banning her for the Mackay Safe Night until 11.59pm June 10.

Solicitor Rob Beamish, of McKay’s Solicitors, said his 30-year-old client had “struggled with alcohol most of her life” and in recent months her “alcohol use had spiralled”, which coincided with a brain injury her sister had recently suffered.

Magistrate Damien Dwyer asked Winn what steps she was taking to address her alcohol issues.

She told Mr Dwyer she had been seeking help from Lives Lived Well “every week”.

Winn was fined $1200 and convictions were not recorded. She was also banned from attending any licensed premises in the Mackay Safe Night Precinct for four months.

Mr Dwyer warned her if she breached his banning order she was “looking at prison”.
