A Mackay man facing serious charges for rape and torture involving BDSM will not yet be handed up to higher courts as lawyers await further evidence.

Tamlin Francis Fitzpatrick-Giles, 26, is alleged to have raped and tortured a 17-year-old girl in Mackay sometime between November and December 2023.

Police further allege the offending involved an act of BDSM (Bondage, Dominance, Submission, Sadomasochism) gone wrong with “cutting and cannibalism themes”.

The matter was listed for committal to District Court on Wednesday, but defence lawyer Marcus Hahn with McKays Solicitors said it could not go ahead.

Mackay Magistrates Court heard both defence and prosecution were awaiting subpoenaed evidence from Victoria Police.

Mr Fitzpatrick-Giles’ appearance was excused, he had been given bail in Townsville Supreme Court on February 14 with strict conditions to live with family and being banned from using the internet.

Magistrate Bronwyn Hartigan adjourned the committal to late May and expanded Mr Fitzpatrick-Giles’ bail.

Anyone convicted of rape faces the possibility of life imprisonment, while torture carries a maximum penalty of 14 years jail if convicted.
