A Bowen magistrate has urged a man to “leave town” after he was arrested following a “brazen” crime spree that involved stealing a car and driving it interstate and hot-wiring a boat.

“Simply helping yourself to other people’s property is unacceptable,” Magistrate James Morton told the 34 year old father.

Bowen Magistrates Court heard homelessness was at the root of Daniel Grant Gaslevich’s offending.

He pleaded guilty to unlawful use of a motor vehicle and a boat, stealing fuel, possessing marijuana and hazardous drugs, used drug utensils, obstructing police and failing to appear.

The court heard he had been in New South Wales and had “nowhere to go” so he had stolen a car and drove it into Queensland.

Police found him asleep in the front seat of that car.

“That’s when things … unfolded for you … bringing you before the court,” Mr Morton said.

Officers had to force entry into the vehicle to arrest Gaslevich.

The court heard he had also stolen a boat from Portsmith in Cairns - the vessel was found floating about 50km offshore at Michealmas Reef.

“Not too sure whether you have sea legs … but you have some ability to know what you’re doing,” Mr Morton said.

“The boat was hot-wired.

“One would say a brazen offence to do.”

Mr Morton said Gaslevich had also stolen fuel “no doubt to fund your venture.

The court heard he was single, to which Mr Morton said “I probably understand why” - he also had a child he did not see.

Gaslevich had a minor criminal history “which I must say is surprising”, Mr Morton said.

“I don’t feel that probation is the answer to your issues … you’re homeless,” he said, adding he took into account the early guilty pleas.

Gaslevich was jailed for seven months, immediately suspended for 18 months. Convictions were recorded and he was disqualified from driving for six months.

“I want to tell you this very clearly … a parting shot,” Mr Morton said.

“You come back before my court for any thieving … I guarantee you … I will send you to jail.

“I don’t know how you’d handle yourself in jail.

“Make sure you don’t go helping yourself to other people’s property.

“Leave town, cause this town obviously isn’t suitable to you.”
