The case for a Bowen teen accused of driving a ute when it crashed and killed his best mate has been pushed back another month as he fights for public funding for his legal representation.
Brett Daniel Matton was charged with driving without due care and attention causing the death of his friend Ethan James Durnsford, who was a passenger in the vehicle.
The crash happened on the Peak Downs Highway on August 8 when a ute and B double collided at Nebo, west of Mackay, about 5.30am.
Mr Durnsford, 18, died at the scene.
Mr Matton first appeared in Mackay Magistrates Court on October 12 when he asked for an adjournment to apply for legal aid.
Today the court heard the 18 year old’s application had been refused.
However Legal Aid Queensland duty solicitor Rosemary Varley said Mr Matton had provided additional pay slips and intended to appeal the decision.
Ms Varley said the process would take several weeks and asked Magistrate Damien Dwyer for a one month adjournment.
Mr Dwyer accepted her request. Mr Matton is next expected to appear in Mackay Magistrates Court in early December.
