A relative of a triple murder accused charged over the alleged execution-style shooting deaths of three family members at a remote Queensland property labelled the court system “a fiasco”, as forensic delays push the process into 2023.
Darryl Valroy Young, 59, has faced fresh weapons charges in Bowen Magistrates Court appearing via videolink from Arthur Gorrie.
He has now been charged with possessing an unregistered category A weapon – a Breda shotgun, a restricted item – a replica weapon, and tainted property – a category A Winchester rifle.
It is the second time Mr Young, a labourer, has appeared in court following the alleged triple murder of his neighbours at the front gate of his Shannonvale property on August 4, 2022.
Sitting in the gallery were two supporters of Mr Young.
One of the supporters claiming to be a relative of Mr Young spoke outside court today and labelled the court system “a fiasco”, before driving off.
Mr Young is charged with three counts of murder for allegedly gunning down Mervyn, 71, and Maree, 59, Schwarz and Maree’s son Graham Tighe, 35, with a rifle at close range at Bogie, west of Bowen.
Police allege Mr Young had invited the family for a chat about a dispute over their property borderline and unbranded cattle when the alleged killings occurred.
Mr Young is also charged with the attempted murder of Graham’s brother Ross Tighe, who was allegedly there and survived the ordeal.
Despite a gunshot wound to the stomach he told police he escaped by running and hiding in bushes as shots allegedly continued to ring out before he was able to reach a farm ute and drive about 40km to a neighbouring property to raise the alarm.
When the case was mentioned in court Magistrate Bronwyn Hartigan arraigned Mr Young on the fresh weapons charges.
It is alleged the weapons were found on August 5, the day after the shootings, at Mr Young’s West Euri Rd, Bowen, property.
The court heard a brief of evidence had already been ordered on the murder charges and attempted murder charge and had been due on October 31.
Police prosecutor Lachlan Perry said a partial brief had been posted to Mr Young’s solicitor Phil Rennick this morning.
Mr Rennick, who appeared via telephone, said he had received an index to the brief which detailed 46 witness statements and 70 plus exhibits.
“The police did indicate that there would be some delay with DNA and ballistics examinations,” Mr Rennick said.
Mr Perry requested a date in January but Ms Hartigan said “I can’t imagine you’re going to be getting DNA and ballistics evidence in the next six weeks”.
The court heard the forensic evidence could take up to three months.
Mr Rennick said once he received the partial brief he would be able to take instructions from his client.
“At least it’s progressing,” Mr Rennick said.
Ms Hartigan said it would be a “waste” of time to list the matter in January and extended the brief of evidence due date to February 3, 2023 with the matter to be mentioned on February 7.
Mr Rennick confirmed Mr Young “does wish to attend on video”. A video link was ordered.
