The case against a Mackay region dad accused of killing his six month old son may face further delays as the three year anniversary of baby Beau’s death clicks over.
Beau Bradshaw was found unresponsive in an East Mackay home on June 2, 2020, allegedly having suffered traumatic brain and other internal injuries.
His father Ayden Bradshaw was then arrested in August 2020 and charged with murder.
Mr Bradshaw’s barrister Scott McLennan told the Mackay Supreme Court on Monday that they had finally found forensic pathologist experts who could report on Beau’s death.
But with a trial date set for November 11 this year, Justice Graeme Crow raised concerns that those experts could run out of time.
“We’ve got four months, (but) experience shows that may not be enough,” Justice Crow said.
“I’m not willing to delist the trial … but if the trial date is kept at least the experts have something to work towards.”
Mr Bradshaw’s defence has contracted forensic pathologist Professor Johan Duflou and forensic paediatrician Dr Jane Edwards.
Mr McLennan had informed the court the delay was worsened by funding issues at the last mention on June 5.
Justice Crow agreed that finding experts was “difficult per se, and it's more difficult finding experts (at) the so-called Legal Aid rate”.
Crown prosecutor Tiffany Lawrence raised further concern about delays.
“It is becoming somewhat concerning that the current listings is a realistic one,” Ms Lawrence said.
“Because once the defence expert reports are obtained, of course then it’s likely that we will need time to provide it to our experts for their comment.
“And experts of this nature can be quite busy.”
Justice Crow set a court date for the case to be mentioned on August 28 to check progress on the expert reports.
Mr Bradshaw’s bail was enlarged.
