What started as a quiet night at home turned into a nightmare for a Slade Point landscaper after she drunkenly jumped behind the wheel to chase offenders who had smashed her car window.

Mackay Magistrates Court heard Audra Annette Daniel and her husband had been drinking earlier in the evening and were in bed when they heard “a loud smash” outside the house about midnight on May 11.

They saw the offenders breaking the windows of her Holden Commodore before fleeing the scene.

Daniel got behind the wheel of the damaged blue Commodore and chased the culprits up the street.

The court heard the pair were assaulted by the group twice, with Daniel’s husband “hauled out of the car and smashed with a fence paling”.

Daniel said the group threatened her, saying “we know where you live, if you tell the police we’ll come back and kill you”.

The Slade Point woman said she was so distressed by what had happened she pulled into a service station and attempted to attract police by flashing her headlights at a passing police car.

The court heard she lead police back to her house where police breathalysed her and she returned a 0.126 blood alcohol concentration.

Daniel’s husband was taken to hospital with “serious injuries”.

The Slade Point woman pleaded guilty to the charge of drink-driving on Thursday.

Magistrate Athol Kennedy acknowledged the unusual circumstances but maintained the seriousness of the offence.

“At the end of the day, it was a smashed window, and then a little bit further on there was a serious assault that has occurred,” he said.

“If they had of simply rung police when they were at home there would have been no serious assaults.”

Daniel was disqualified for three months and fined $650.

No conviction was recorded.
