A man charged with threatening a Mackay mental health clinic and pouring petrol on its premises has requested a second psychological report.
Allan Ray Craig was deemed mentally fit enough to go to trial by an initial report, but his lawyer told Mackay Magistrate Court another assessment was being completed by Brisbane’s chief psychiatrist.
He had been released on bail after the incident at Mackay Community Mental Health Service on November 4, 2022, but had since returned to custody after allegedly driving drunk and breaching his bail.
His lawyer Danny Yarrow, of ATSILS, said the new report would be expected by May 22, pushing back his hearing date to May 29.
The court heard Craig had two further charges for a bail breach and drunk driving which had returned him to Capricornia Correctional Centre.
Magistrate Bronwyn Hartigan said while a psych report had deemed him fit for trial, the next hearing for the bomb hoax, bail breach and drunk drive charges should be delayed until the second had been presented.
She said Craig was nearing four months inside and was concerned his pre-sentence custody would soon outpace his potential sentence.
“I’m worried he’s spending too much time in custody, which is probably why I let him out last time,” Ms Hartigan said.
“If all he’s done since I gave him bail is a drink drive and a breach of bail, he shouldn’t be back in custody.”
Craig was released on immediate bail on March 21 and was not required to wear a tracker, but remains banned from being within 100m of the mental health clinic.
