A Mackay man accused of attacking a couple on a Tinder date at North Wall beach has applied for bail after months in jail.
Aaron James Davis, 32, and Kashya Ann Poyner, 26, allegedly wore balaclavas and wielded a hockey stick when they attempted to carjack the couple and then kidnapped a woman on November 13, 2022.
A police raid of a Bucasia home led to their arrest and additional charges when drugs and suspected stolen property were found.
Davis faced Mackay Magistrates Court to apply for bail after eight-and-a-half months in pre-sentence custody on July 28.
His defence lawyer Aaron Sellentin said Davis had a detailed rehabilitation plan for release, intending to move to Rockhampton to live with his twin sister and her family.
‘The crux of the submission is that he essentially has served sufficient time,” Mr Sellentin said.
“Continuing to hold him in custody risks him serving too much time.
“In this matter, he’s given significant extra assistance to the police in the form of a statement.”
Police prosecutor Ruth Whisker said she could confirm there had been “some assistance to the police” in Davis’ matter.
“I’ve considered the alleged facts of the charges and they are extremely serious,” Ms Whisker said.
“That being said, he has spent eight months in custody.
“It has been very well set out by his solicitor the plans he has and what he’s been able to achieve in custody.”
Ms Whisker said that, given a number of strict conditions, the prosecution would not object to Davis’ bail.
Acting Magistrate Stephen Byrne released Davis on bail with strict reporting conditions including a curfew and no contact order with Poyner as well as witnesses and victims.
“Look on this as a last chance … your future is in your hands,” Mr Byrne said.
Poyner, Davis’ co accused, had her bail application rejected by Magistrate Damien Dwyer on November 19.
Both Davis and Poyner are charged with deprivation of liberty, attempted armed robbery in company, and disguising their faces while intending to commit an indictable offence.
Davis is further charged with two counts of possessing suspected stolen property, failing to dispose of a syringe, and possessing dangerous drugs and utensils.
His trial committal date is not yet set, with the next mention of his matter on October 30.
