A Mackay woman with a history of offending spat on police when they came to her home.
Crystal May Hoare, 38, was previously sentenced in Mackay court for offences involving an animal.
Hoare was placed on probation for two years for the offending in June 2024 and convictions were recorded.
Four months later on October 1, 2024 police came to her house for a matter unrelated to her previous offending.
Defence solicitor Sarah Reid said Hoare was intoxicated when police arrived.
“She was in her pyjamas … my client tells me she didn’t want to go to the watch-house dressed in her pyjamas,” Ms Reid said.
The court heard the officers refused her request to change and she spat at them, her spit landing on the officer’s vest and arm.
She was then charged with two counts of serious assault of a police officer by spitting and two breaches of bail, pleading guilty.
The court heard Hoare had six children and she was supported in court by her mum, stepdad and partner.
Ms Reid said Hoare’s struggle with drug use began when she was 12 — when she started using marijuana — and escalated to more serious drugs.
“She’s been diagnosed with a number of mental health conditions … she’s been engaging with mental health for some time,” Ms Reid said.
Magistrate Damien Dwyer said Hoare had a serious criminal history, with offending dating back to 2011 and she had appeared before court 11 times for “contempt of court authorities”.
“Police have got a job to do and what you did is a complete and utter contempt of the court,” Mr Dwyer said.
“For no other reason that you were cranky and drunk.”
Mr Dwyer said it was time Hoare had a “look in the mirror” and referred to Hoare’s previous breaches of court orders, arson and “that matter from last year”.
“If your mental health was that bad what’d you get on the grog for … it’s everybody elses fault but yours,” Mr Dwyer said.
“You just seem to think that you can do whatever you wish.”
Hoare was imprisoned for six months wholly suspended and a parole release date was set for June 27, 2025.
Convictions were recorded.
