Jag Patrick Stephan guilty of Fortitude Valley public nuisance

A boozy fight between mates on a night out in Brisbane’s party precinct has proven costly for an Ipswich youth, whose smile will never be the same.

One-punch attacks: How lethal are they?

An Ipswich youth, bloodied, shirtless and missing a front tooth, was arrested in Brisbane’s party precinct after a wild punch-on outside a popular nightclub, a court has heard.

East Ipswich man Jag Patrick Stephan, 21, formerly of Beaudesert, pleaded guilty in Ipswich Magistrates Court this week to public nuisance in the vicinity of a licensed premise.

The court heard the offence occurred outside Fortitude Valley’s Alfred & Constance nightclub about 10.15pm on Saturday, August 14 this year.

Police prosecutor Sergeant Trent Voigt said police were called to the disturbance and saw a large number of people outside the nightclub.

Stephan had no shirt, appeared intoxicated and was being walked away by security officers.

He had lost a tooth and staples in the back of his head had been reopened, the court heard.

“He had been fighting with an associate. They were friends,” Sgt Voigt said.

Defence lawyer Erin Dwan said Stephan was a former roofer now working in turfing, and lives with an aunty.

“He says there were no drugs involved and accepts it was alcohol,” Ms Dwan said.

“The other person involved was a close friend and for whatever reason they had an altercation.”

Ms Dwan said Stephan hadn’t been drinking since the offence.

The court heard Stephan had three prior entries on his criminal history for public nuisance.

“Whatever is going on this has got to stop,” Magistrate Dennis Kinsella said.

“It really concerns me when you find a young bloke like yourself getting yourself into these situations,” Mr Kinsella said.

“You need to work out your relationship with alcohol, if it is good for you or not.

“You lost a tooth out of this.”

“Yep,” Stephan said.

“Have you seen the dentist? It will be an expensive lesson,” Mr Kinsella said.

“I get it back this week. A couple of grand, at least two,” Stephan said.

“Are you still friends,” Mr Kinsella inquired.

“No,” said Stephan.

Mr Kinsella said he was still young at 21 and it was a case where his male brain had not yet fully developed and this impacted on judgment and decision making.

“However, you are not exactly a first-timer in such matters,” he said.

Stephan was convicted and sentenced to a nine-month probation order.

He must complete alcohol counselling and other programs.
