A young Ipswich man was on a suspended prison sentence for attacking a cop and spitting on a paramedic when he stabbed a man during a shocking road rage incident at Walloon.
An Ipswich District Court heard Shane Bill Rayer, 22, had been driving with a mate along a rural road when he began tailing a car on September 18, 2020.
Crown prosecutor Amy Stannard said the victim indicated for Rayer to overtake him although Rayer abruptly cut him off causing the man to yell out his window.
Rayer then slowed down and swerved around the road to block the man’s attempts to overtake.
Police prosecution said the situation escalated when Rayer told the man to pull over.
“What’s your f—king problem?” the victim asked.
Rayer yelled back: “It’s a 100km zone!”
During a “scuffle” the victim heard the word knife and began scrambling for a rock, although when he stood back up empty-handed he felt something hit his chest.
Rayer’s friend said, “what the f--k did you do that for, get back in the car?”
The man in his 40s drove to Walloon Saloon Hotel for help and was later transferred to hospital in a serious condition, where he stayed overnight.
The deep stab wound caused blood to flow into his chest and a cavity near his heart.
Defence barrister Anna Cappellano said Rayer had come from a broken home and had difficulty processing emotions which led to a marijuana addiction.
After spending over 300 days in custody, Ms Cappellano said with the support of his mother Rayer was determined to get his life on track and had completed a number of rehabilitative and general programs while in prison.
Judge Dennis Lynch told the young man that random acts of violence committed in the community were deeply concerning but said he believed Rayer was genuinely remorseful of his actions.
Judge Lynch said it was an aggravating factor that Rayer committed the crime while on a suspended sentence and parole for similar crimes.
In 2019 Rayer was convicted of “disgusting” crimes he committed after drinking at an Ipswich pub with mates.
Rayer instigated a fight with patrolling officers which led to him kicking an officer in the head, spitting in an officers mouth, and in the face of an ambulance paramedic.
On Thursday, January 27, Rayer pleaded guilty to fresh charges of causing grievous bodily harm, breaching a suspended sentence, contravening a probation order, and was sentenced to three years jail.
Judge Lynch declared 361 days of pre-sentence custody as time served and ordered an immediate parole release date.
The now Lockyer Valley man has already lined up a job building chicken coops although he plans to become a qualified welder when he gets his licence back.
