‘Ready, set, go’: 125kg DV monster Dale Patrick Whalley tells girlfriend to run before choking her unconscious

A Banyo plumber has faced court for a series of drunken assaults, which included him holding his girlfriend against a wall by the neck and choking her unconscious while she pleaded with him to stop.

Dale Patrick Whalley, 32, pleaded guilty in Ipswich District Court on September 21, 2022, to assault occasioning bodily harm whilst armed, two counts of wilful damage, two counts of choking (DV), assault occasioning bodily harm (DV), stealing, assault occasioning bodily harm and supplying a dangerous drug.

The charges related to four separate incidents and three victims, with the domestic violence offences all occurring one evening in 2021.

The court heard Whalley, a father of two, arrived at his girlfriend’s house severely intoxicated around 9pm and began attacking her for an unknown reason.

He held the woman up to the wall by her neck, choking her as she fell in and out of consciousness.

Judge Terry Gardiner said “she had been trying and pleading with you to stop,” and noted Whalley far overpowered her, weighing 125kg at the time.

Whalley told her “I will give you a five second head start, ready set go,” before hitting her in the face and calling her “scum, a dog and a fraud”.

He headbutted her, causing her to fall and hit the tiled floor, with her teeth cutting into her cheeks on impact.

Later in the evening, Whalley yelled “baby, what’s for dinner” before throwing a frying pan full of food across the kitchen.

He then choked her again and used a core hammer to smash two holes in the walls of her hallway.

The woman suffered two black eyes, a bump to her nose, swollen cheeks and a split inside her mouth.

Whalley’s other offences included assaulting the friend of a previous partner in August, 2020, after drinking at the friend’s house.

The friend had intervened when she noticed Whalley nitpicking and being aggressive towards his partner.

He ultimately threw his partner’s friend into a table multiple times, threatened her with a carving knife, and punched a hole in her linen cupboard.

Whalley was further charged with assaulting a co-worker in Toowoomba after a night of drinking in December, 2021.

The two were waiting outside for an Uber when Whalley hit the other man in the face, and he fell backwards towards a nearby car.

He was struggling to get up when Whalley kicked him in the head, forcing the victim‘s head to snap back and strike the car, knocking him unconscious.

Whalley picked up the man’s phone and left in the Uber, and was taken into custody soon after.

While incarcerated, Whalley enlisted his partner at the time to collect two packages and bring them to the Brisbane Correctional Centre.

The police intercepted her when she arrived, and found she had been attempting to smuggle in 48 subutex strips, valuing $9600 to $14,400.

The court heard Whalley had an extensive, violent criminal history including multiple assaults occasioning bodily harm between 2010 and 2020.

Defence lawyer Simone Bain said Whalley had experienced significant personal trauma as a child and struggled with substance abuse from a young age.

She pointed out gaps in his criminal history that she said demonstrated he was able to stay out of trouble when he stayed on top of his substance abuse.

Whalley received a head sentence of five years imprisonment, with his parole release date set for December 19, 2023.

His 275 days of presentence custody were declared time-served, and convictions were recorded.
